D. New Business
1. File #W2004-29 – Application to rebuild house in the same location with an addition
on 7 Liska Road (Map 31, Lot 3). Owner/Applicant: Gary Zelonka. (Received
9/27/04, Decision by 11/8/04.)
Both Gary Zelonka and Tom Sanperi were present to speak. Mr. Zelonka said the house presently measures 32 ft. on the back, and they want to build a new addition about 40 ft. The house will be about 75 ft. from the river, which is forested on the bank. He said they have received approval from the Health District.
Metzler said it is an existing structure and all activity will be taken on the upland side (all activity is within the regulated area), and the site is stable. He said he would like staff to do a site walk and report back.
Dirrigl requested a narrative and history for the record and for decision-making.
Mr. Sanperi said the house will have a full basement. Yorgensen asked about footing drains, and Mr. Sanperi said he wasn’t certain they were required. She asked if the building inspector mentioned the necessity of footing drains, and Mr. Sanperi said no.
Metzler said we’ll need to know the discharge locations for foundation drains, stockpile location, and what sedimentation and erosion controls will be used.
Mr. Zelonka said the tree line is behind the shed. He said he would check with the inspector on the footing drains and make an appointment with Asst. Agent Jones to come out.
Metzler indicated the application will be on the agenda for the October 25 IWC meeting.
2. File #W2004-30 – Application for a single family house with driveway and utilities
crossing wetlands and regulated area on property at 212 River Road (Map 19, Lot 25).
Owner/Application: Lynnthea Mackovich. (Received 9/27/04; Decision by 11/8/04.)
No one was present. The application was tabled.
E. Pre-Application
1. John and Ann Starinovich to construct a pond on property at Lustig Road.
Mr. Starinovich said the property consists of 8 acres. He handed out copies of the map. Joseph Polulech, P.E., said the property consists of two parcels: Parcel A has almost 8 acres, and there are 20 acres altogether. Of the 20 acres, almost 7 acres are wetlands. He said there is an existing trailer with a septic system and dug well on Parcel A.
Mr. Starinovich said he and his wife would like to eventually move here from Tolland and build a house on Parcel A.
Mr. Polulech said there are two different proposals. One is to have a 1.3 acre pond. He said he did an analysis of the flow. He said there is a 12-acre drainage area, half from the other side of the road through a 15-inch pipe, the remainder from the side hill. The drainage divided about at the parcel division. In the proposed plan the flow would be in the same direction, flowing eventually into the Fenton River.
Mr. Polulech said the second proposal would involve a slightly smaller pond -- .98 acres – in the same location, primarily in the wetland. Groundwater will keep the pond full at the same elevation that it outlets today.
Mr. Starinovich said a 2 x 4 would control the water level; there would be no dam or dike. A depth of 10 l/2 ft. is proposed. He said he hired Tim Dodge, retired from NRCS, to inventory the wildlife within the area.
Schreiber asked if test pits have been dug, and Mr. Polulech said no, but he plans to do them. He said the wetland soils are poorly drained.
Metzler asked about the outlet structure, and Mr. Polulech replied that it will be a vegetative earth outlet without erosion. He said that so far this year, every one of the storms has been contained. Metzler asked about alternative, and Mr. Polulech said they don’t really have any, although the pond may be shifted slightly. A total of 10,500 cu. yards of material will be coming out. They need the upland space to get rid of it. Some of the pond already is in the upland area.
Metzler asked about the proposed residence, and Mr. Polulech said they are pursuing the pond first, saying that if the pond can’t be built, the residence probably won’t be built, either. He said the pond will be planted. The pond has a shelf. Metzler asked if they have a vegetation management plan, and Mr. Polulech replied yes. He said that at 3-5 ft. vegetation will grow, but the deeper water should be clear.
Yorgensen asked if they had plans for Parcel B, and Mr. Starinovich said they will probably combine them as one. Some of the area will be put in a “490,” although they don’t know the procedure for doing so.
Dirrigl said he would like to see a narrative with as much information as possible.
Yorgensen asked about the purpose of the proposed pond, and Mr. Starinovich said it would simply be a wildlife pond.
Metzler asked Yorgensen to send a “pond package” to each Commission member.
Mr. Polulech said the high ground water would keep the pond full. Metzler asked about the substrate, and Mr. Polulech said he would investigate.
Metzler said that the “pre-application” could be discussed at the next (October 25) meeting of IWC.
2. Michael Anthony, 22 River Road, Replacement Garage.
Mr. Anthony said he presently has a two-car detached garage with carport, and it has deteriorated to the point that it is not repairable. An intermittent brook goes into a man-made swale. He said he wants to move the garage 5 ft. away from the intermittent brook, 13 ft. away from the property line, but otherwise basically use the same footprint. This will shorten up the driveway a little bit. Mr. Anthony requested that the matter be remanded to staff.
Metzler asked if Mr. Anthony had seen water flowing in the intermittent brook, and he replied once in a while. Metzler asked if test holes have been done, and Mr. Anthony replied no.
Yorgensen said that she would have to look at the property and then send the matter back to the Commission.

staff when it come in.

F. Applications Received Post-Agenda Filing
1. File #W2004-32 – Application for a single family home on property at 12 Turnpike
Road Extension (Map 45, Lot 7). Owner/Applicant: Earl Melendy. (Received
9/27/04; Decision by 11/8/04.)
Earl Melendy handed out maps. He said all work is outside the 100 ft. regulated area. He showed an alternative. He said he didn’t think the 250 ft. requirement is in effect in this situation.
Yorgensen read the regulations and stated the 250 ft. regulated area does apply, to which Mr. Melendy replied that the house location would be within the 250 ft.
Mr. Dirrgil said the brook involved is Ruby Brook.
Schreiber commented that the entire area is in the upland review area.
Metzler asked if the area was wooded now, and the applicant replied yes.
Mr. Melendy said the wetlands are flagged.
Metzler said a site walk should be done on an individual basis. Yorgensen noted that staff hadn’t reviewed it yet. Mr. Melendy said that he had been in touch with Asst. Agent Jones, who had given him some suggestions.
G. Old Business
1. File W2004-11 – Notice of Violation – Maintaining a stump pile, stockpile of
potential topsoil, and compacted brush storage pile within a wetland and upland
review area on Clover Springs Farm Subdivision Phase II property located off Battye
Road. (Map 9, Lot 7). Owner: Joseph Voboril.
Joseph Voboril pointed out the location of the stump pile and the relocation after the stumps are chipped.
Metzler asked what kind of truck will be used, and Mr. Voboril replied probably a 14-wheeler. Metzler asked about the crossings, and Mr. Voboril replied that they will be gravel; there will be a hard base.
Yorgensen asked why the road will not be used, and Mr. Voboril replied that it is not paved yet.
Metzler asked about the slope, and Mr. Voboril replied that 10% is the maximum slope. Metzler said he agreed with Agent Yorgensen’s suggested about using the road instead. It would mean less hauling. Yorgensen said the new S&E control guidelines state that unless the slope is 2:1, wood chips should not be spread. Speaking to Voboril, she said that his composting suggestion is good and it would make “great use” of the chips.
Metzler asked Yorgensen to contact Karl Acimovic about this Violation.
Mr. Voboril went over how the processing would be done.

J. Staff Report and Discussion
The Senior Center and its lack of erosion control was discussed. Yorgensen said the detention basin was practically filled up with silt. Yorgensen said that silt fences need to be picked up and cleared out.Metzler suggested that a Notice of Violation be sent to Mike concerning the matter.
There was discussion concerning the need for Public Works to clean up the roads/parking lots promptly. Metzler asked Yorgensen to prepare a letter to Karl Acimovic, saying that we want to have all sand collected before the next meeting. He said we need to have the First Selectman meet with us. There was a brief discussion about having a maintenance schedule. Dirrigl suggested that information be sent to Mike.
Schreiber said that Marco Road and Daleville Road have mud crossing them.
